Terms and Conditions of Use

These Terms and Conditions of Use and Sale (the Terms) govern the use of the Javer online store, the information provided through the website, the placing of orders and the contractual relationship between the customer and the seller.

By using this online store and/or placing an order, you acknowledge that you have read these Terms.

Flossy Eesti OÜ is referred to in these Terms as the Seller, we, us or our.

2. Application of These Terms

These Terms apply to the use of the online store and to purchases made through it.

By placing an order, the customer confirms that they are entitled to enter into the relevant contract and that the information provided by them is accurate and up to date.

Consumers retain all mandatory rights provided by applicable European Union and other applicable consumer protection legislation.

If any provision of these Terms conflicts with mandatory consumer protection law, the relevant mandatory legal provisions will apply.

3. Product Information

We make reasonable efforts to present the products offered in the online store as accurately as possible, including their descriptions, colours, sizes, photographs and other main characteristics.

Actual product colours may differ slightly from those displayed on a screen due to different display settings, lighting, photography and other technical factors.

Before placing an order, the customer has the opportunity to review the main characteristics of the selected product.

4. Prices

All prices displayed in the online store are stated in euros (EUR) and include applicable taxes unless expressly stated otherwise.

Delivery charges, where applicable, are not included in the product price unless expressly stated otherwise.

Any applicable delivery charges and the total amount payable are displayed to the customer before the order is finally confirmed.

If an incorrect price is displayed due to a technical or obvious error, we will contact the customer and explain the situation. Such cases will be handled in accordance with applicable law.

5. Placing an Order

To purchase a product, the customer selects the desired product, size, quantity and any other available options and submits the order through the online store's checkout system.

Before confirming the order, the customer has an opportunity to review and, where necessary, correct the order information.

The customer must provide accurate information necessary to process and deliver the order, including their name, contact details and delivery information.

After an order is placed, an electronic order confirmation is provided to the customer.

6. Formation of the Sales Contract

The sales contract is concluded electronically.

Order confirmation and other information relating to the purchase will be provided to the email address supplied by the customer or through another electronic method used by the online store.

The Seller reserves the right to lawfully decline or cancel an order where fulfilment is objectively impossible, for example where a product is no longer available. In such a case, the customer will be informed and, if payment has already been made, the relevant amount will be refunded.

7. Payment

Products may be paid for using the payment methods offered in the online store during checkout.

Available payment methods are displayed on the checkout page.

The customer is responsible for ensuring that the payment information provided is correct and that they are authorised to use the selected payment method.

8. Delivery

We use Venipak, Unisend and Omniva for order deliveries.

Available delivery methods, prices and other delivery information applicable to a particular order are displayed during checkout.

The customer is responsible for providing accurate delivery and contact information.

Where no specific delivery period has been agreed, the goods will be delivered within the period required by applicable law.

9. 14-Day Right of Withdrawal

Consumers generally have the right to withdraw from an online sales contract within 14 days after receiving the goods, without giving a reason, subject to exceptions provided by applicable law.

To exercise the right of withdrawal, the consumer must clearly inform the Seller of their decision within the applicable period.

Consumers may also use the electronic withdrawal function provided through the online store where applicable.

After exercising the right of withdrawal, the consumer must return the goods within the period required by applicable law.

10. Condition of Returned Goods

The customer may inspect and try the product to the extent reasonably necessary to establish its nature, characteristics and functioning, in a manner comparable to what would be permitted in a physical shop.

Shoes should therefore only be tried on indoors and on a clean surface.

If a product has been handled beyond what is necessary to establish its nature, characteristics and functioning, the consumer may be responsible for any resulting reduction in its value.

Where possible, products should be returned with their original packaging, labels and accessories.

11. Returns and Exchanges

Returned products may be sent using Venipak, Unisend or Omniva according to the instructions provided on our Delivery & Returns page.

Please include a printed order document, receipt or invoice showing the customer's name and order number inside the return parcel.

If you cannot print the document, write the customer's full name and/or order number on a piece of paper and clearly state whether you would like a RETURN/REFUND or an EXCHANGE.

For an exchange, please specify the desired size or replacement product.

Exchanges are subject to availability.

12. Return Costs and Refunds

When exercising the 14-day right of withdrawal, the customer bears the direct cost of returning the goods unless the Seller states otherwise or applicable law requires the Seller to bear that cost.

When the consumer lawfully withdraws from the entire distance contract, amounts required to be reimbursed under applicable law will be refunded, including the cost of standard delivery. Additional delivery costs resulting from the customer's choice of a more expensive delivery method than the standard option offered by the Seller do not have to be reimbursed.

Refunds will normally be made using the same payment method used for the original transaction unless expressly agreed otherwise.

Where permitted by law, the Seller may withhold reimbursement until the returned goods have been received or until the customer provides evidence that the goods have been sent back.

13. Defective or Non-Conforming Products

Customers have the statutory rights applicable to defective goods or goods that do not conform to the sales contract.

Consumer goods are covered by the applicable minimum two-year legal guarantee, where required by law.

Where goods are defective or non-conforming, consumers are entitled to the remedies provided by applicable law, which depending on the circumstances may include repair, replacement, a price reduction or termination of the contract and a refund.

We will make reasonable efforts to review the matter and find an appropriate solution.

Nothing in these Terms limits a consumer's right to refer a dispute to a competent alternative dispute resolution body or court where such a right exists under applicable law.

15. Personal Data and Privacy

Customers' personal data may be processed for the purposes of accepting and fulfilling orders, administering payments and deliveries, providing customer service and for other lawful purposes.

16. Intellectual Property

The content of the online store, including texts, design, graphics, logos, photographs and other materials, may be protected by copyright, trademark and other intellectual property rights.

Such content may not be used for commercial purposes without permission from the relevant rights holder except where permitted by law.

17. Acceptable Use of the Website

Users must not use the online store for unlawful purposes, attempt to interfere with the operation or security of the website, obtain unauthorised access to the website, servers or other systems, or use the website in a manner that infringes the rights of others.

18. Liability

The Seller does not exclude or limit liability where such liability cannot lawfully be excluded or limited.

The Seller is not responsible for disruption or loss to the extent caused by circumstances reasonably outside the Seller's control. Nothing in this provision limits any mandatory statutory consumer rights.

19. Changes to These Terms

The Seller may update these Terms from time to time, for example as a result of changes in legislation, website functionality, delivery methods or business processes.

An order will generally be governed by the version of the Terms applicable when that order was placed, unless applicable law requires otherwise.

The current version of these Terms will be published in the online store.

20. Applicable Law

Flossy Eesti OÜ is a company registered in Estonia.

These Terms and contracts concluded through the online store are subject to applicable law.

Where the customer is a consumer residing in another European Union Member State, the choice of applicable law does not deprive the consumer of protection afforded by mandatory provisions of the law of their country of residence where those provisions apply.
